For quality assessment, training, licensing, credentialing, auditing, compliance, and administrative operations necessary to operate our practice.

Legal and Regulatory Requirements

When required or permitted by law, including disclosures under Florida Statutes Chapters 395, 456, and 381, public health reporting requirements, court orders, subpoenas, regulatory agencies, or law enforcement as permitted by law.

3. Uses and Disclosures Requiring Authorization

We will obtain your written authorization before using or disclosing your PHI for purposes not described in this Notice, including:

  • Marketing activities
  • Disclosure to third parties not involved in your care

You may revoke your authorization at any time in writing, except to the extent action has already been taken in reliance on your authorization.

Requests may be subject to reasonable fees as permitted by Florida and federal law.

5. Security of Your Information

We implement reasonable administrative, technical, and physical safeguards to protect your PHI in compliance with HIPAA and applicable Florida data protection laws. While no system is completely secure, we take appropriate steps to safeguard your information.

6. Changes to This Policy

We reserve the right to modify this Privacy Policy at any time. Changes will apply to PHI we already maintain as well as future information. Updated notices will be posted on our website and made available upon request.

9. Compounded Medication Disclaimer:

The medications referenced on this website are compounded medications. Compounded medications are not approved by the U.S. Food and Drug Administration (FDA) as finished drug products. They are prepared using FDA-approved active pharmaceutical ingredients by licensed compounding pharmacies in accordance with applicable state and federal regulations.

10. Prescription Requirement Statement:

All medications offered through Obas Lab Diagnostics & Wellness require a valid prescription issued following a medical consultation with a licensed provider. No medication will be dispensed without an appropriate medical evaluation

11. HIPAA Breach Notification Language:

In the event of a breach of unsecured protected health information, Obas Lab Diagnostics & Wellness will notify affected individuals and, where required, the U.S. Department of Health and Human Services and/or the media, in accordance with the HIPAA Breach Notification Rule (45 CFR §§ 164.400-414).

12. Patient Rights Statement:

You have the right to access your medical records, request corrections or amendments to your records, request restrictions on certain uses and disclosures of your information, and receive an accounting of disclosures. Telehealth Consent

Effective Date: December 2025

Telehealth involves the use of electronic communications and technology to provide healthcare services remotely. Telehealth services provided by Obas Lab Diagnostics & Wellness comply with Florida Statute §456.47 and all applicable federal laws.

By scheduling or participating in telehealth services, you acknowledge and agree to the following:

1. Nature of Telehealth Services

Telehealth services may include:
  • Virtual consultations
  • Medical evaluations
  • Review and discussion of test results
  • Treatment recommendations
  • Prescription management, when clinically appropriate and permitted by law

2. Provider Licensure

All healthcare providers delivering telehealth services are licensed or authorized to practice in the State of Florida, as required by Florida law. Telehealth services are provided only to patients located in jurisdictions where such services are legally permitted.

3. Benefits of Telehealth

Telehealth services may provide:
  • Convenient access to care
  • Reduced travel and wait times
  • Improved continuity of care

4. Risks and Limitations

You understand that:

  • Telehealth may not be appropriate for all medical conditions
  • Technical failures, delays, or interruptions may occur
  • Some conditions may require in-person evaluation or referral
  • Telehealth does not guarantee a diagnosis or treatment outcome

5. Privacy and Security

Telehealth services use secure technology designed to protect your privacy in compliance with HIPAA and Florida law. Despite safeguards, there is a small risk of unauthorized access.

6. Emergency Situations

Telehealth is not appropriate for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room immediately.

7. Consent to Treatment

By participating in telehealth services, you:

  • Consent to receive healthcare services via telehealth
  • Acknowledge that you may withdraw consent at any time
  • Agree to provide accurate and complete health information

8. Prescription Policy (Florida-Specific)

Prescriptions may be issued only when medically appropriate and permitted by law. Under Florida law:

  • Providers must document a patient evaluation consistent with the standard of care
  • Certain controlled substances may require an in-person evaluation or may be restricted from telehealth prescribing
  • Prescribing practices comply with Florida and federal regulations

9. Financial Responsibility

You agree to be financially responsible for all telehealth services provided, in accordance with our posted fees, billing policies, and Florida law.

By using telehealth services from Obas Lab Diagnostics & Wellness, you acknowledge that you have read, understand, and agree to this Telehealth Consent.
